1. Agreement to Terms
By downloading, installing, or using any application or game ("Apps") developed by Up N Flames Studio ("we", "us", or "our"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use our Apps.
2. Use of Our Apps
Our Apps are intended for personal, non-commercial use. You agree not to:
- Use the Apps for any unlawful purpose
- Attempt to reverse engineer, decompile, or disassemble any part of the Apps
- Modify, adapt, or create derivative works based on the Apps
- Use automated systems or bots to interact with the Apps
- Interfere with or disrupt the Apps or servers
- Exploit bugs or glitches for unfair advantage
3. Accounts
Some features may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 13 years old to create an account.
4. In-App Purchases
Our Apps may offer in-app purchases. All purchases are processed through the applicable app store (Apple App Store or Google Play Store) and are subject to that store's terms and refund policies. In-app purchases are non-transferable. Virtual items and currency have no real-world monetary value and cannot be exchanged for cash.
5. Subscriptions
Some Apps may offer subscription-based access to premium features. By purchasing a subscription, you agree to the following:
- Payment will be charged to your App Store or Google Play account at confirmation of purchase
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price
- You can manage and cancel your subscriptions by going to your account settings on the App Store or Google Play Store after purchase
- Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription
Subscription prices may vary by region and are displayed in your local currency before purchase. Price changes will not affect active subscription periods.
6. Intellectual Property
All content in our Apps — including but not limited to graphics, text, code, sounds, and gameplay mechanics — is owned by Up N Flames Studio and protected by copyright and intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Apps for personal purposes.
7. User Content
If our Apps allow you to submit content (such as usernames, messages, or custom game elements), you grant us a non-exclusive, royalty-free license to use, display, and distribute that content within the Apps. You are responsible for ensuring your content does not violate any laws or third-party rights.
8. Disclaimers
Our Apps are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Apps will be uninterrupted, error-free, or free of viruses or other harmful components.
9. Limitation of Liability
To the maximum extent permitted by law, Up N Flames Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Apps, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
10. Termination
We may terminate or suspend your access to our Apps at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App or on our website. Your continued use of the Apps after changes are posted constitutes acceptance of the revised Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
